Judecatoarele Mera si Costiniu au facut eforturi mari pentru a explica de ce Sorin Ovidiu Vantu si Octavian Turcan trebuie cercetati in libertate. De cealalta parte, opinia contra a judecatoarei Rotaru arata fara echivoc de ce Vantu si Turcan trebuiau sa ramana inchisi.Lait motivul pro-eliberare il constituie intrebarea de ce Parchetul nu i-a retinut pe cei doi imediat dupa inceperea urmarii penale, adica in decembrie 2009. Raspunsul este dat de colega de complet Rotaru: pentru ca raspunsul autoritatilor din Cipru a sosit abia in septembrie si pentru ca Vantu si Turcan au luat legatura cu fugarul Nicolae Popa dupa ce a inceput urmarirea penala impotriva lor . “Comisia rogatorie din Cipru reprezenta o proba importanta ce contura presupunerea rezonabila ca inculpatii au savarsit faptele penale din perioada octombrie – 2 decembrie 2010, proba care ar fi trebuit sa existe la dosar la momentul solicitarii unei masuri preventive de o asemenea gravitate”, arata Cristina Rotaru in motivare.
“…Probele obţinute pe calea comisiei rogatorii efectuate in Cipru nu ofera elemente cu caracter de noutate, ci confirma o situatie deja cunoscuta si evidentiata inca de la data inceperii urmaririi penale. Pe cale de consecinta, comisia rogatorie efectuata in Cipru este lipsita de relevanta din perspectiva conturarii pericolului pe care inculpatii l-ar prezenta, la acest moment, pentru ordinea publica”, contracareaza Costiniu si Mera.
Altfel spus, procurorii n-ar fi trebuit sa astepte declaratiile din Cipru (sosite la Parchet la inceputul lui septembrie) ci ar fi trebuit sa ceara arestarea in lipsa acestei probe esentiale. Se pune intrebarea ce judecator ar fi luat in seama o asemena propunere si ar fi decis arestarea doar pe baza unor interceptari telefonice.
Sa presupunem ca Parchetul ar fi cerut arestarea preventiva a lui Vantu in 2 decembrie 2009, data la care a inceput urmarirea penala impotriva sa si cand a fost prins de Interpol, Nicolae Popa. Retinerea lui Vantu cu patru zile inainte de turul II al alegerilor prezidentiale, ar fi fost argumentul suprem al “dictaturii” ce ne paste daca-l votam pe Basescu, explicatie oferita de slujbasii “formatori de opinie” din ograda mogulului.Motivarea data azi publicitatii ne demonstreaza inca odata arbitrariul legilor dar mai ales jongleriile interpretarii lor. Atata timp cat magistratii nu pot fi trasi la raspundere pentru o decizie oricat de scandaloasa ar fi, sunt nevoit sa ma minunez zilnic de toleranta speciei umane.
