Avocatul Gheorghe Piperea a anuntat luni ca a depus la Tribunalul Bucuresti o cerere de chemare in judecata a BCR, semnata de 362 de clienti ai bancii, prin care acestia solicita anularea comisioanelor abuzive. In plus, clientii cer instantei suspendarea platii ratelor la credite, pe timpul desfasurarii judecatii. Acesta este primul proces colectiv declansat de clienti impotriva unei banci din Romania.
“Cele mai multe credite sunt ipotecare, dar sunt şi împrumuturi de consum cu costuri ridicate, în cazul cărora se percepe de exemplu un comision de monitorizare a riscului de circa 4% pe an, stabilit nu la soldul rămas de plată, ci la valoarea iniţială”, a explicat Piperea.
Printre clauzele considerate abuzive de clienţii BCR se mai numără şi dobânda de referinţă internă a băncii.
În ultimele trei luni tot mai mulţi clienţi nemulţumiţi de clauzele din contractele încheiate cu bănci s-au organizat pe yahoo în cadrul unor grupuri pentru a discuta despre problemele întâmpinate şi despre implementarea noilor reglementări din domeniul bancar, introduse prin OUG 50 privind creditele populaţiei. Primul grup a fost format de clienţii Volksbank, ulterior fiind create grupuri împotriva clauzelor introduse de mai multe bănci, printre care BCR, Bancpost, ING, Credit Europe Bank, OTP Bank şi Alpha Bank.
Piperea a menţionat că în cazul clienţilor Volksbank nu au fost încă definitivate listele cu persoanele care vor începe procesul colectiv împotriva băncii.
“Din perspectiva concilierii cu Volksbank nu mai este nimic de aşteptat, fiind siguri că mergem în instanţă. Din păcate, însă, nu am definitivat listele cu persoanele care vor participa la proces”, a spus Piperea.
