Institutiile publice au cheltuit nejustificat 75 milioane euro pe avocati privati

Curtea de Conturi a contatat ca, in perioada 2008-2010, 408 institutii publice au cheltuit aiurea aproape 75 de milioane de euro pe case private de avocatura, desi aveau departamente speciale de consilieri juridici. Inspectorii de la Curtea de Conturi sustin ca nu este normal ca autoritatile sa plateasca in paralel doua servicii de asistenta juridica: propriilor angajati si unei societati de avocatura, din afara institutiei.
“Avem de a face cu un aspect cunoscut, dar nereglementat pana in prezent, care a evoluat in timp s-a transformat intr-un adevarat fenomen a carui consecinta este cheltuirea ineficienta a banului public. Legea nu contine interdictii, dar asta nu inseamna ca aceeasi autoritate poate sa efectueze cheltuieli cu personalul public de specialitate juridica, cat si cheltuieli cu firme private de avocatura, care de multe ori, egaleaza sau depasesc pe cele cu structura juridica proprie”, se arata in raportul Curtii.
Astfel, potrivit controlului inspectorilor Curtii de Conturi fiscali, din perioada 2008-2010, efectuat la 408 institutii publice, s-a constatat ca acestea au angajat 6.798 de specialisti juridici, pentru care s-au cheltuit 274.639.131 lei. Aceleasi institutii au incheiat contracte cu firme de avocatura in valoare de 317.859.345 lei (aproximativ 75 milioane euro).
Cele mai mari cheltuieli cu societatile de avocatura le-au avut Ministerul Finantelor si Compania Nationala de Autostrazi si Drumuri(CNDAR). Desi are 131 de juristi, pentru care s-au cheltuit 2,4 milioane de lei in perioada 2008-2010, Finantele au angajat firme de avocatura, incheiand contracte in valoare de 108, 7 milioane de lei. Aceste firme sunt: SC Tanase, Leana, Cadar si Asociatii, SC Tuca, Zbarcea si Asociatii, SC Nestor, Diculescu, Kingston.
De asemenea, CNDAR are 653 de juristi, dar a angajat firme de avocatura, cheltuind 89 de milioane de lei.
Alte institutii care au angajat firme private de avocatura sunt Ministerul Culturii, Ministerul Transporturilor, CFR, Aeroportul International Baneasa, SC Metrorex SA, Autoritatea Aeronautica, Tarom, Electrica, Nuclearelectrica, Termoelectrica, Hidroelectrica, SC Electrocentrale SA.
De exemplu, Electrica a avut cheltuieli cu personalul juridic de 301.187 lei, iar pentru avocati a alocat suma de 3,57 milioane de lei, Hidroelectrica – cu personalul propriu, 906.800 lei, iar cu avocatii – 7,5 milioane lei, iar Nuclearelectrica – cu personalul propriu, 1,7 milioane lei iar cu avocatii – 7,6 milioane lei.
