“Achitatul” Bradisteanu se intoarce la tribunal

Judecatorii Curtii de Apel Bucuresti au decis ca dosarul medicului Serban Bradisteanu, acuzat ca ar fi achizitionat aparatura medicala supraevaluata, trebuie rejudecat de Tribunalul Bucuresti, instanta care l-a achitat in urma cu un an in acest dosar.
In urma contestatiei facute de procurorii DNA, judecatorii instantei superioare au decis rejudecarea cauzei. In decembrie 2009, Tribunalul a hotarat ca Bradisteanu nu este vinovat in dosarul in care este acuzat de abuz in serviciu si luare de mita in legatura cu licitatia din 2001, prin care au fost utilate spitalele-penitenciar. In urma cu un an, judecatoarea Elena Burlan, buna prietena cu avocata Alice Draghici, aparatorul lui Bradisteanu, s-a pronuntat ferm in motivare, sustinand ca “este neverosimil ca medical sa fi primit o mita de 40% din valoarea contractului”, adica aproximativ 4 milioane de euro.
Procurorii au atacat decizia Tribunalului pe motiv ca Bradisteanu a mintit instanta, la ultimul termen de judecata cand a declarat ca cele patru milioane de euro, erau comisioanele legale destinate unei foste paciente care i-a devenit ulterior si prietena, Cornelia Pachiu, iar el a fost un simplu intermediar.

In 2001, pe cand era senator PSD, medicul Bradisteanu era seful unei comisii de licitatie pentru dotarea cu aparatura medicala a sistemului penitenciar. In urmatorii trei ani, a primit de la firma castigatoare, intr-un cont deschis intr-un paradis fiscal, patru milioane euro. In fata instantei, Bradisteanu a relatat o poveste demna de scenariul unei telenovele. Banii de la firma elvetiana i-ar fi parvenit prin intermediul unei foste paciente, Cornelia Pachiu, reprezentantul in Romania a firmei de aparatura medicala. Acesta a decedat in 2006, imediat dupa inceperea urmarii penale in acest dosar. Banii livrati de elvetieni au intrat intr-un cont deschis de Bradisteanu in Elvetia, dar era destinati pentru achizitionarea unui imobil de catre numita Pachiu. Deoarecere sotul nu trebuia sa stie de existenta acestor bani, Pachiu l-ar fi rugat pe Bradisteanu sa deschida un cont pe numele lui, sumele urmand a ajunge la sotia discreta prin intermediul medicului. Judecatoarea Burlan a consemnat ca atare declaratia lui Bradisteanu fara a face o minima verificare. Dealtfel, sotul Corneliei Pachiu a infirmat scenariul pus la punct de Bradisteanu, afirmand ca fosta sotie a devenit pacienta medicului la un an dupa ce doctorului i-au intrat in cont cele patru milioane euro.
Mai mult, anchetatorii au stabilit ca Bradisteanu a continuat sa scoata bani din contul din Elvetia si dupa decesul fostei paciente, lucru neluat in seama de magistratul care l-a achitat.
