Curtea Constitutionala arunca in aer alegerile de la CSM

Curtea Constitutionala a Romaniei a admis marti sesizarile PDL privind modul in care Senatul a validat lista magistratilor alesi in Consiliul Superior al Magistraturii (CSM), precum si alegerea lui Victor Alistar in Consiliu din partea societatii civile. Deocamdata nu se stie clar daca vor fi reluate alegerile in CSM sau se reia procedura de validare in Senat.
Cel mai probabil se va adopta a doua varianta, deoarece alegerile in CSM nu se mai pot organiza.
Pe 22 decembrie, Senatul a validat, cu 64 de voturi ”pentru” si 60 ”impotriva”, lista magistratilor alesi membri ai CSM. Parlamentarii de la guvernare si cele din opozitie s-au certat pe procedura care trebuia urmata.
PDL sustinea ca senatorii trebuie sa valideze individual pe noii membrii, in vreme ce Opozitia a optat pentru alegeri pe lista.
Anterior, presedintele Traian Basescu a adresat Consiliului rugamintea de a amana alegerea conducerii noului CSM pana cand Curtea Constitutionala a Romaniei se va pronunta asupra celor doua contestatii.
Si ministrul Justitiei, Catalin Predoiu, a transmis atunci catre Inalta Curte de Casatie si Justitie si catre CSM solicitarea de amanare a sedintei de constituire a Consiliului. Ministerul mentiona ca propunerea de amanare a sedintei de constituire a CSM pana dupa data pronuntarii deciziei Curtii Constitutionale justifica interesul de a asigura credibilitate justitiei romane in spatiul intern si european.
