Motivarea arestarii lui Nicolescu: un exemplu pentru combaterea infractionalitatii

Tribunalul Arges sustine ca presedintele CJ Arges, Constantin Nicolescu, a savarsit fapte de coruptie “de mare gravitate” in forma continuata. In motivarea arestarii, judecatorii sustin ca a luat decizia arestarii preventive “pentru ca asupra inculpatului planeaza suspiciunea savarsirii unor fapte de coruptie care, in opinia instantanei, are o mare gravitate, data fiind repetabilitatea si amploarea acestora, modalitatea si imprejurarile concrete de savarsire a presupuselor fapte, iar utilizarea calitatii de functionar public in scopul obtinerii de foloase cu titlul de mita, diminueaza prestigiul de care ar trebui sa se bucure autoritatile locale”.
“Nu putem face abstractie de nemultumirea pe care ar trezi-o in randul persoanelor oneste, care apeleaza cu buna credinta la serviciile autoritatilor publice, lipsa de reactie a organelor judiciare sesizate cu savarsirea unor fapte de natura, gravitatea si amploarea celor spune mai sus, mai ales ca masura arestarii preventive nu exclude o doza semnificativa de exemplaritate”, se mai arata in documentul Tribunalului Arges.
De asemenea, judecatorii mai spus ca “in acest sens, apreciem de o gravitate deosebita, susceptibila in a sustine masura arestarii preventive, si ultima fapta imputabila prin actul de acuzare, referitoare la instigarea unor primari in scopul neindeplinirii atributiilor de serviciu”.
Constantin Nicolescu a fost arestat, joi seara, pentru luare de mita si trafic de influenta.
