A devenit o regula ca judecatorii sa-i ierte pe politicienii acuzati de fapte de coruptie. Un exemplu este Mihail Sireteanu, fost deputat PSD si ex-vicepresedinte al CNSLR Fratia, acuzat ca a fraudat Fabrica de Armament din Mizil cu peste sase miliarde de lei vechi. Judecatorii de la Inalta Curte de Casatie si Justitie (ICCJ) au stabilit, miercuri, ca este vinovat, insa l-au condamnat la doi ani de inchisoare cu suspendare. De asemenea, fostul director general in MFA, Mizil Constantin Cazacu, a primit trei ani de inchisoare cu suspendare.
Judecatorii au decis ca lui Sireteanu sa-i fie confiscati 9.852 de lei si s-a instituit sechestru asigurator pe o parte din bunurile lui acestuia.
Decizia poate fi atacata cu recurs la completul de 5 judecatori al ICCJ.
Procurorii Directiei Nationale Anticoruptie (DNA) il acuza pe Mihai Sireteanu ca ar fi fraudat Fabrica de Armament din Mizil cu peste sase miliarde de lei vechi, in perioada 2003-2004.
Din probele administrate de procurori a reiesit ca, in perioada 2003-2004, Sireteanu si Cazacu au pus in aplicare un plan prin care au fost create doua societati comerciale – Emco Cas si Euro Business – menite sa desfasoare activitati comerciale privilegiate cu fabrica de armament MFA Mizil.
Constantin Cazacu era director general in MFA Mizil, iar Mihail Sireteanu, membru in Consiliul de Administratie pana la data de 28 mai 2003.
Potrivit procurorilor, cei doi au inlesnit incheierea a 17 conventii comerciale cu cele doua firme-capusa in care erau fie actionari, fie aveau interese si care erau administrate de persoane paravan aflate in relatii de rudenie ori de prietenie cu cei doi inculpati.
Mihail Sireteanu a incalcat Legea 161/2003, se arata in rechizitoriul DNA, prin faptul ca a cumulat calitatile de deputat, membru al Comisiei pentru cercetarea abuzurilor, coruptie si pentru petitii cu cea de cenzor al uneia dintre firmele capusa, si anume Emco Cas. Totodata, Mihail Sireteanu era actionar la firma Euro Business, administrata de ginerele acestuia.
Din probele administrate a reiesit ca, dupa afacerile cu firmele capusa – Emco Cas si Euro Business – fabrica de armament MFA Mizil a platit 4,69 miliarde lei vechi catre Emco Cas, respectiv 1,9 miliarde lei vechi catre Euro Business, fara ca aceste doua firme sa presteze vreo activitate aducatoare de venituri pentru MFA Mizil.
