Fost director la Termoelectrica, arestat pentru inselaciune

Curtea de Apel Bucuresti a decis, miercuri, arestarea preventiva pentru 29 de zile a fostului director al Termoelectrica, Ioan Ungureanu, a unui executor judecatoresc (Dragos Paul Rocosanu) si a doi avocati (Ovidiu Benone Voicu si Ioan Daniel Ionas), acuzati de o inselaciune de mai multe milioane de euro, in legatura cu cesiuni de creanta privind companii de stat. In august 2007, Termoelectrica SA a chemat in judecata societatea Electrica SA, pentru o datorie pe care aceasta din urma o avea de achitat.
Ulterior, SC Termoelectrica, prin directorul general Ioan Ungureanu, a cesionat ilegal creanta avocatului Ovidiu Voicu Benone, dupa care a incheiat cu acelasi avocat un contract de asistenta juridica in litigiul respectiv.
La 30 martie 2009, instanta a obligat societatea Electrica sa achite cabinetului avocatului Voicu suma totala de 31.557.229,06 lei (7.470.000 de euro), suma incluzand datoria initiala, penalitati de intarziere si cheltuieli de judecata. In perioada aprilie-august 2009, prin manevre frauduloase desfasurate in cadrul procedurii de executare silita, executorul judecatoresc Dragos Rocosanu, impreuna cu avocatii Voicu si Ionas, au incarcat, in mod nejustificat, nota de plata pe care Electrica urma sa o achite ca urmare a executarii silite, pana la valoarea de 78.654.057 (18.621.381 euro). Prin aceleasi manevre, suma mentionata, executata silit de la SC Electrica SA a revenit in totalitate societatii comerciale Recovery Best Solution SRL (al carei reprezentant unic este Ioan Daniel Ionas) si cabinetului de avocat Benone Ovidiu Voicu.
Procurorii anticoruptie au mai stabilit ca, in 29 mai 2009 si 16 iunie 2009, societatea Electrica platise la Termoelectrica suma totala de 31.539.229,06 lei, in conformitate cu sentinta instantei de judecata.
Pe de alta parte, si Termoelectrica a fost executata silit de Biroul Executorului Judecatoresc Rocosanu, pana la concurenta sumei de 7.812.650 lei (1.851.338 euro).
Printr-un mod de operare similar, “care a presupus manevre frauduloase (inexistenta titlului executoriu si stabilirea unor cheltuieli de executare supraevaluate)”, cei trei acuzati au determinat executarea silita a societatii Asirom Teleorman SA, pana la concurenta sumei de 10.000.000 de lei (2.370.000 de euro).
De asemenea, procurorii mai arata ca Dragos Rocosanu a executat silit un imobil situat in Bucuresti, cu incalcarea drepturilor de creanta a partii vatamate, in favoarea unui alt creditor, neindreptatit.
