Magistratii Curtii de Apel Bucuresti l-au condamnat pe directorul SIF Oltenia, Dinel Staicu, la 7 ani de inchisoare cu executare pentru savarsirea infractiunilor de abuz in serviciu, dupa ce acesta a fraudat BIR cu 187 de miliarde de lei vechi. Decizia este definitiva, iar Dinel Staicu va fi incarcerat. Fost militian in vremea comunistilor, el a facut avere cu terenuri si actiuni la SIF Oltenia, fiind o vreme si patronul echipei de fotbal Universitatea Craiova.
In acelasi dosar, fostul presedinte al BIR, Ion Popescu, a primit 7 ani inchisoare cu executare, Radian Raceala, fostul director al Directiei de creditare din BIR, cinci ani inchisoare cu executare, in timp ce Viorica Dutu, fostul sef al serviciului de creditare de la aceeasi banca, a primit patru ani de inchisoare cu suspendare.
Cei patru au fost trimisi in judecata de procurorii DNA in noiembrie 2006. Potrivit DNA, in perioada iulie 1999-februarie 2000, Ion Popescu, Radian Raceala si Viorica Dutu au aprobat, cu incalcarea normelor bancare, cesiuni de creanta in valoare de 106.786.123.000 de lei vechi si credite in valoare de 80.535.611.000 de lei vechi catre unsprezece societati comerciale controlate de Dinel Staicu. Cesiunile de creanta au fost efectuate cu incalcarea principiului prudentialitatii bancare, fiind acordate unor societati nou-infiintate, in conditii favorabile cesionarilor.
Dinel Staicu a solicitat si a obtinut incheierea conventiilor de cesiune de creanta si a contractelor de credit cu incalcarea dispozitiilor legale si a folosit sumele de bani astfel obtinute in interesul altor societati pe care le controla. O parte din banii obtinuti de la BIR sub forma de imprumuturi, aproximativ 40 de miliarde de lei vechi, au fost folositi de inculpat la cumpararea unor actiuni de la SIF Oltenia, prin intermediul unor societati pe care le controla.
Valoarea mare a contractelor incheiate contrar dispozitiilor legale, modalitatea in care au fost aprobate imprumuturile, folosirea sumelor de bani obtinute in interesul altor societati, creditele care depaseau cu mult valoarea fondurilor proprii ale bancii au reprezentat modalitati prin care Dinel Staicu i-a ajutat pe functionarii bancii sa comita infractiunea de abuz in serviciu contra intereselor persoanelor.
Procurorii sustin ca prejudiciul cauzat, prin infractiune, bancii este de 187.321.734.408 lei vechi la nivelul anului 2000.
