Condamnarile la CEDO costa Romania 3,6 milioane euro

Romania a fost condamnata pe parcursul anului 2010 de catre CEDO pentru incalcarea dreptului la proprietate in 61 de cauze, suma totala a despagubirilor impuse statului roman ridicandu-se la 3,6 milioane euro, a declarat luni, subsecretarul de stat in MAE Razvan-Horatiu Radu, agentul guvernamental pentru CEDO. Per total, Romania a platit 43 de milioane de euro in perioada 2000-2009 ca despagubiri fixate de CEDO in cauze de incalcare a drepturilor de proprietate.
Suma pentru 2010 este mult mai mica decat in anii anteriori. Astfel, in anii 2008-2009, Romania a platit 12 milioane de euro.
De asemenea, potrivit bilantului prezentat de oficialul MAE, in anul 2010 CEDO a analizat aproximativ 3.800 de plangeri indreptate impotriva Romaniei, aproximativ 97% fiind respinse, 136 de hotarari fiind de condamnare a statului roman. Dintre acestea, 72 au constatat nerespectarea dreptului la un proces echitabil, 21 incalcarea dreptului de a nu fi supus torturii sau tratamentelor inumane sau degradante (16 referitoare la conditiile neadecvate de detentie din penitenciare), 15 – nerespectarea dreptului la libertate si la siguranta.
In anul 2009, impotriva Romaniei se inregistrasera 11.950 de plangeri la CEDO, tara noastra situandu-se atunci pe locul trei in privinta adresabilitatii cetatenilor nemultumiti de hotararile judecatoresti in clasamentul celor 47 de state membre, fiind devansata de Rusia si Turcia, insa in 2010 Romania nu s-a mai situat pe acest loc, dupa cum a precizat agentul guvernamental pentru CEDO.
‘Hotararea-pilot a Curtii in cauza Atanasiu si altii contra Romaniei din 12 octombrie 2010 ofera perspective rezolvarii definitive a problemei dreptului de proprietate in materia caselor nationalizate, piste de solutionare a problemei, precum si un termen de 18 luni de solutionare’, a subliniat oficialul MAE.
El a aratat ca prin decizia premierului din 3 decembrie 2010 s-a constituit un grup de lucru interministerial pentru elaborarea unui proiect de lege care sa aplice recomandarile Curtii din hotararea-pilot, iar acest proiect aflat in prezent in faza de lucru va fi supus dezbaterii publice inainte de trimiterea in Legislativ.
Pe de alta parte, in cazul in care nu va fi rezolvata aceasta problema de catre statul roman in termenul prevazut de 18 luni, incepand din 12 ianuarie a.c., noua procedura a Curtii va tine cont de plangerile repetitive si va creste semnificativ numarul de condamnari ale statului roman in materia incalcarii dreptului de proprietate, a avertizat subsecretarul de stat.
‘Vom fi practic bombardati cu condamnari’, a afirmat Razvan-Horatiu Dan, el aratandu-si insa optimismul in privinta implementarii prevederilor hotararii-pilot, deoarece nicio astfel de procedura recomandata de CEDO nu a inregistrat esec.
Totodata, oficialul MAE a aratat ca anuntata listare la bursa a actiunilor Fondului Proprietatea va fi un ‘pas util’ in procesul de aparare a statului roman la CEDO in cauzele de acest tip, deoarece Curtea a retinut in ultimii ani ca acest mod de despagubire a fostilor proprietari reprezenta ‘un sistem teoretic si iluzoriu’, nu unul ‘practic si efectiv’.
