Consiliul Superior al Magistraturii (CSM) a sesizat Autoritatea Nationala de Supraveghere a Prelucrarii Datelor cu Caracter Personal (ANSPDCP) in legatura cu publicarea de catre cotidianul.ro a fotocopiei cartii de identitate a judecatoarei Camelia Bogdan. Magistratul amintit il judeca pe Sorin Ovidiu Vantu in procesul in care este acuzat de favorizarea infractorului, dupa ce l-ar fi sustinut financiar pe Nicolae Popa, individ retinut intre timp in Indonezia.
CSM mai arata ca “…in cazul ce a făcut obiectul sesizarii de catre Consiliu a ANSPDCP – este incidentă Legea 677/2001 pentru protectia persoanelor cu privire la prelucrarea datelor cu caracter personal si libera circulatie a acestor date”. Potrivit acestui act normativ, sesizarea va fi data in lucru unui inspector din cadrul ANSPDCP, care, dupa verificari, va fi obligat sa aplice reglementarile in vigoare. La capitolul “sanctiuni”, aceeasi norma prevede ca publicarea datelor personale fara acordul celui vizat “constituie contraventie, daca nu este savarsita in astfel de conditii incat sa constituie infractiune, si se sanctioneaza cu amenda de la 15.000.000 ROL la 250.000.000 ROL”.
La ultimul termen de judecata, avocatii lui Vantu au cerut recuzarea magistratului care judeca acest dosar, pe motiv ca tatal acestuia ar fi pierdut o anumita suma de bani la FNI. In sprijinul materialului, site-ul detinut de Cornel Nistorescu a publicat chiar in ziua procesului o copie a cartii de identitate a judecatoarei si adresa parintilor ei, fara nicio legatura cu demersul jurnalistic propriu zis.
