Emilian Cutean, condamnat la cinci ani inchisoare

Magistratii Tribunalului Bucuresti l-au condamnat pe fostul deputat si sef al Secretariatului de Stat pentru Problemele Revolutionarilor, Emilian Cutean, la cinci ani de inchisoare cu executare, acesta fiind acuzat de procurorii DNA ca a initiat o hotarare de Guvern in 2004, prin care s-a aprobat acordarea a peste 300.000 de lei Asociatiei de revolutionari ‘Club 22’, pe care o infiintase si al carei presedinte era. Cutean este unul din cei mai ferventi aparatori ai lui Ion Iliescu.
De asemenea, instanta a decis ca, dupa executarea pedepsei, lui Emilian Cutean ii sunt interzise, timp de trei ani, drepturi civile, intre care si dreptul de a ocupa o functie intr-o autoritate publica.
In acelasi dosar, fostul director economic al Secretariatului de Stat pentru Problemele Revolutionarilor Daniela Zbarcea a primit trei ani de inchisoare cu suspendare, cu un termen de supraveghere de sase ani.
Emilian Cutean a fost obligat sa plateasca 7.000 de lei cheltuieli judiciare catre statul roman, in timp ce Daniela Zbarcea trebuie sa achite 3.000 de lei.
In schimb, instanta a anulat decizia Judecatoriei Sectorului 1 privind plata a 88.240 de lei (Emilian Cutean-58.240 lei, Daniela Zbarcea-30.000 lei ) cu titlu de diferenta de onorariu de expertiza contabila pentru expertul contabil Irimia Dida, astfel ca acesti bani vor fi platiti de Ministerul Justitiei.
Decizia instantei nu este definitiva, putand fi atacata cu recurs.
Practic, Tribunalul Bucuresti a mentinut condamnarile date de Judecatoria Sectorului 1, instanta de fond modificand doar o parte din sumele ce trebuie achitate de cei doi inculpati.
Pe 26 ianuarie 2006, procurorii DNA au dispus inceperea urmaririi penale a lui Emilian Cutean, sub acuzatia de evaziune fiscala, in baza documentelor puse la dispozitie de presedintele Asociatiei ‘Decembrie 1989 Metrou Romania’, George Costin.
Asociatia sesizase procurorii in legatura cu o hotarare de Guvern initiata de Cutean in decembrie 2004, prin care se aprobase acordarea a peste 300.000 de lei Asociatiei de revolutionari ‘Club 22’, pe care o infiintase si al carei presedinte era.
In sesizare se arata ca, potrivit declaratiei de interese depuse la dosar, Emilian Cutean indeplinea si functia de presedinte al Asociatiei ‘Club 22’ si functia de ordonator de credite in calitate de secretar de stat la Secretariatul de Stat pentru Problemele Revolutionarilor.
